Egyptians vote on disputed constitution

CAIRO (AP) ? Egyptians were voting on Saturday in the second and final phase of a referendum on an Islamist-backed constitution, but there was little indication that the result of the vote will end the political crisis in which the country is mired.

The vote comes a day after clashes between supporters and opponents of Islamist President Mohammed Morsi in the Mediterranean port city of Alexandria. It was the latest outbreak of street violence in more than four weeks of turmoil, with the country divided first over the president's powers then over the draft constitution.

The clashes ? in which opponents of Islamists set fire to cars and dozens of people were hurt ? illustrated how the new constitution, regardless of whether it is adopted or not, is unlikely to ease the conflict over the country's future.

Saturday's vote is taking place in 17 of Egypt's 27 provinces with about 25 million eligible voters. The first phase on Dec. 15 produced a "yes" majority of about 56 percent with a turnout of some 32 percent, according to unofficial results.

"I came early to make sure my 'no' is among the first of millions today," oil company manager Mahmoud Abdel-Aziz said as he waited in line outside a polling station in the Dokki district, part of Giza province but also in the greater Cairo area. "I am here to say 'no' to Morsi and his Muslim Brotherhood," he said.

Another Giza voter, accountant and mother of three Sahar Mohamed Zakaria, had a different take on Saturday's vote.

"I'm voting 'yes' for stability," she announced.

In part, Egypt's split has been over who will shape the country's path nearly two years after the ouster of Hosni Mubarak nearly two years ago.

An opposition made up of liberals, leftists, secular Egyptians and a swath of the public angered over Morsi's 5-month-old rule fear that Islamists are creating a new Mubarak-style autocracy. They accuse the Brotherhood of monopolizing the levers of power and point to the draft charter, which Islamists on the Constituent Assembly rammed through despite a boycott by liberal and secular members. They are calling on supporters to vote "no."

Morsi's allies say the opposition is trying to use the streets to overturn their victories at the ballot box over the past two years. They also accuse the opposition of carrying out a conspiracy by former members of Mubarak's regime to regain power.

Ky. court upholds decision in penis removal case

LOUISVILLE, Ky. (AP) ? A Kentucky man lost his bid Friday to force a doctor to pay damages for removing a cancer-riddled section of his penis during what was scheduled to be a simple circumcision.

The Kentucky Court of Appeals found that a jury correctly concluded that 66-year-old Phillip Seaton of Waddy consented to allow Dr. John Patterson to perform any procedure deemed necessary during the Oct. 19, 2007, surgery.

Patterson, a Kentucky-based urologist, maintains he found cancer in the man's penis during surgery and that it had to be removed. The patient claims the surgery was supposed to be a circumcision and he never authorized the amputation, nor was he given a chance to seek a second opinion.

"Additionally, there is uncontroverted testimony in the record that if Mr. Seaton were not treated for the penile cancer, it would prove fatal in the future," Judge Janet Stumbo wrote for the court.

Judge Michael Caperton dissented, but did not issue a written opinion.

Clay Robinson, a Lexington-based attorney for Patterson, said the opinion was "very well-reasoned" and fact-based.

"You always appreciate when you see judges at any level go into that amount of detail," Robinson said.

Seaton and his wife, Deborah, sued Patterson, a Kentucky-based urologist, in Shelby County Circuit Court in 2008. Seaton, now in his 60s, was having the procedure to better treat inflammation. The Seatons also sued Jewish Hospital, where the surgery took place. The hospital settled with the couple for an undisclosed amount.

Both sides agree that Seaton had squamous cell carcinoma, a type of skin cancer, in his penis. Patterson concluded that a tumor had overtaken much of the top of the organ, which made it impossible to insert a catheter.

"He also opined that serious complications and additional surgery could result if he did not insert the catheter," Stumbo wrote.

The main point of contention is whether Patterson acted reasonably in removing the organ immediately or if amputation could have been delayed to let Seaton seek other medical options.

Stumbo and Judge Donna Dixon concluded that, even though Seaton had limited ability to read and write, he never informed the doctor of that fact and signed the consent form in the presence of a witness. The Seatons claimed that the waiver didn't give Patterson authority to conduct an amputation without further consent.

"They maintain that no harm would have resulted if Dr. Patterson has consulted with either of them before proceeding, or if he had allowed them to consult with another physician to get a second opinion or other treatment options," Stumbo wrote.

Stumbo wrote that Patterson acted properly because the tumor had consumed such a large section of the organ.

"For this reason alone, the resection of the tumor was 'necessary and proper' in the context of inserting a catheter," Stumbo wrote.

Kevin George of Louisville, the attorney for Seaton, did not immediately return messages seeking comment.

NYSE in multibillion dollar buyout deal with ICE

1 hr.

The NYSE, the public face of the U.S. capitalism for almost two centuries, will be bought by much-younger rival IntercontinentalExchange in a $8.2 billion dollar deal that would create a stock and commodities trading behemoth.

The deal, announced Thursday by?ICE,? values the NYSE at $33.12 a share in stock and cash. Once the deal is?closed, NYSE shareholders would own approximately 36 percent of ICE shares.

?Analysts said a deal would give Atlanta-based ICE a strategic boost with control of Liffe, Europe's second-largest derivatives market, helping it compete against U.S.-based CME Group Inc , owner of the Chicago Board of Trade.

An ICE-NYSE Euronext tie-up would leap-frog Deutsche Boerse to become the world's third-largest exchange group with a combined market value of $15.2 billion. CME Group, ICE's largest U.S.-based rival, has a market value of $17.5 billion, Thomson Reuters data shows.

Hong Kong Exchanges and Clearing ?is the world's largest exchange group with a market capitalization of $19.5 billion.

ICE's main operations are in energy futures trading and unlike NYSE Euronext, it has steered clear of stocks and stock-options trading, so there is not much business overlap between the two groups, making it more likely competition authorities would approve a tie-up.

Last year, the U.S. Justice Department blocked a $11 billion joint hostile bid by ICE and Nasdaq OMX Group for NYSE Euronext on concerns the tie-up would dominate U.S. stock listings.

If that bid had succeeded, ICE planned to buy NYSE Euronext derivatives business while Nasdaq would have taken control of the stock exchanges.

A rival $9.3 billion bid by German exchange operator Deutsche Boerse also ran afoul of regulators.

"I doubt the competition authorities will have a problem with it, there's only a modest overlap between the businesses," said Richard Perrott, an analyst at Berenberg Bank.

"The rationale for the deal will be the same as that with Deutsche Boerse - migrate the clearing of Liffe derivatives to ICE's services in London and scale up to attract OTC (Over The Counter) derivatives clearing. There could be more than $300 million in cost savings in the deal."

Before the latest ICE offer emerged, NYSE Euronext's shares had fallen by nearly a third since ICE and Nasdaq launched their thwarted joint bid.

The New York Stock Exchange, known as the Big Board and the symbol of U.S. capitalism, has seen its clout fade as new technology and the rise of private trading venues run by Wall Street banks and brokers cut its margins.

Founded in 2000 as a U.S. electricity trading platform backed by Wall Street banks and energy traders, ICE is the product of a string of acquisitions, from the London-based International Petroleum Exchange in 2001 through the New York Board of Trade and, most recently, a handful of smaller deals, including a climate exchange and a stake in a Brazilian clearing house.

SparanoAP

Before placing blame for the Jets? misguided decision to acquire quarterback-of-all-trades Tim Tebow and their inability to use him effectively, a determination must be made that blame should be placed.

In the apparent opinion of Jets offensive coordinator Tony Sparano, there?s no reason for blame because the Tebow experiment wasn?t a disaster.

?It?s combination of things but I wouldn?t use the words ?didn?t work? at all,? Sparano said, via Jane McManus of ESPNNewYork.com.

?We had a plan going into this thing,? Sparano said.? ?But obviously the plan always, at that particular time, was that Mark was the quarterback and Tim would have a role and to what degree the role was, if I remember correctly, it was one-to-20 plays in a game.? Some days it was eight, some days it was one, some days it was none.? Just predicated on what we saw out there.? Tim has worked really hard out here, he?s done a good job, he?s worked hard on the practice field, but that?s where we are.?

Sparano is right about that one-to-20 snaps; he cited that number back in May.? Still, there was an expectation that Tebow would do a lot more than he did.

The effort to declare victory and retreat from Tebow includes an explanation from Sparano that presumptions of multiple big plays from the Tebow package were inaccurate.? ?The way that I think the perception is of the Wildcat is that we had a bunch of these 30-yard gains,? Sparano said. ?That wasn?t the case in Miami, either.? In Miami, it wasn?t the case at all. We just did it a lot more, so the two-yard gains and the five-yard gains [didn?t stand out[, but then the 15-yard gain, I guess that jumped out more than the two or the five.?

So if the bar was that low, why not use Tebow more often?? After all, one of the stated goals was to force opposing defenses to spend less time preparing for the base offense by accounting for the Tebow package.? Once it became clear that:? (1) Tebow wouldn?t be used much on offense; and (2) when used the outcome would be nothing like, for example, Miami?s torching of the Patriots in 2008, there was no need to worry about Tebow.

There also was no need to worry about the Jets? offense.? Ranked 30th in total yards and 31st in yards per play, the franchise is moving in the wrong direction under Sparano.

Thus, regardless of whether the Tebow package was a failure or a success (and if it really was a success we?d hate to see what it would have looked like if it were a failure), Sparano likely will soon be joining Tebow as a former employee of the team.

Iraqi president taken to Germany for treatment

By QASSIM ABDUL-ZAHRA
Associated Press

BAGHDAD (AP) - Iraqi President Jalal Talabani was flown to Germany early morning Thursday for further medical treatment after suffering a stroke earlier this week, according to officials.

The ailing 79-year-old president was rushed to a Baghdad hospital late Monday. Several government officials have said Talabani suffered a stroke, though his office and doctors have released few details about the seriousness of his condition.

He appeared to be responding to treatment and showing signs of improvement by Wednesday, his doctors and other officials said.

Lawmaker Mahmoud Othman said that Talabani left Baghdad to Berlin after a German medical team recommended the president be taken abroad for treatment. It was not immediately known what German hospital Talabani would be taken to.

The presidential office confirmed that Talabani was on his way to Germany.

In a statement on its official website, the office said the treatment he underwent in Baghdad "provided the right conditions for the transfer of (Talabani) out of the country for follow-up treatment in Germany." It gave no further details on his condition.

Firyad Rawndouzi, a senior member of Talabani's Patriotic Union of Kurdistan party, said Talabani left for Berlin around 6 a.m. with German medical team that had flown in the previous day.

"His health condition is stable and much better. I can't comment on details over his condition because this is left to the medical team," he said.

The presidency of Iraq is largely a ceremonial role. Prime Minister Nouri al-Maliki is the head of government.

Although his official powers are limited, Talabani is a senior Kurdish leader and has been a symbol of unity in Iraq. He has frequently used his position to mediate among Iraq's Sunnis, Shiites and Kurds, as well smaller minority groups.

Talabani is overweight and has undergone several medical procedures in recent years, including heart surgery in 2008 and knee replacement surgery this year. He has previously received treatment in Germany.

Before he fell ill, Talabani was actively involved in trying to mediate in a crisis between Baghdad and the Kurds, who have their own fighters and considerable autonomy in their enclave in northern Iraq.

The two sides last month moved additional troops into disputed areas along the Kurds' self-rule region, prompting fears that fighting could break out.

Last week, Talabani brokered a deal that calls on both sides to eventually withdraw troops from the contested areas, though there was no timetable for how soon the drawdown might take place.

Iraq's parliament has the authority to choose a new president should Talabani's office become vacant. The Kurds would likely insist on retaining the presidency to maintain the government's power-sharing balance.
